Release of Seized Vehicles: Problems, Financial Loss and Legal Uncertainty

A seized vehicle is bad news for its owner as he is deprived of transportation while the costs keep mounting up. For a common man owning vehicle, that may translate into disrupted school drop-offs and hospital trips for his family. For taxi driver / transporter that could mean loss of livelihood, where income from vehicle feeds his family and pays EMI for the vehicle.

Release of seized vehicles entails into a complicated procedure when ownership, cause of seizure and connection of vehicle to the alleged crime is challenged. This subject focussed article has been drafted for BK Singh Advocate to highlight the problems owners undergo.

Why Does Vehicle Seizure Create Financial Pressure?

Suspension of loan EMIs/other commitments doesn't happen automatically once you lose access to the vehicle. EMI distress, rental costs for alternate transportation and depreciation can overlap for an owner. Lost bookings, lost deliveries, loss of consumer faith are commercial impacts during the downtime of the vehicle.

Whether you live in Delhi NCR, Mumbai, Chennai, Bengaluru or any other city in India, your dependence on your vehicle dictates the impact. If a family relies on the income from a single taxi, seizure of that vehicle impacts the whole family.

Quick Facts

  • Seizure does not conclusively prove the owner's culpability.
  • Temporary forfeiture and permanent forfeiture are separate considerations.
  • Automobiles can be held as evidence of a suspected crime.
  • There may be conflicting claims of ownership.
  • There may be unique laws with independent forfeiture clauses.
  • The longer storage occurs the more degradation and cost occurs.

Why Is the Reason for Seizure So Important?

Motor Vehicles can be seized under accidents, alleged theft, criminal investigations or traffic offenses. Each of these offenses do not have the same legal ramifications. Owners become confused when they are unaware if the vehicle is being held as evidence, contested ownership or liable for forfeiture.

As per Bharatiya Nagarik Suraksha Sanhita, 2023 Sections 497 and 503 deal with separate matters pertaining to custody and relinquishment of confiscated property. The context of the statute applies; you cannot determine why a vehicle has been seized by the registration sticker alone. Website: bprd.nic.in

Uncertainty of consequence is the focus of this article by BK Singh Advocate.

Commercial Vehicle Seizure Can Affect More Than the Owner

When a truck is seized, a small transporter misses out on an opportunity for income. Jobs can be delayed, customers can take their business to competitors, and drivers can lose days of work. A fleet of only one or two trucks doesn’t have much room for this type of disruption.

Lost income and ongoing costs can happen simultaneously. Loan payments, payroll obligations and other overheads must be paid even while the truck brings in no income. Losses can continue after the seizure if customers find alternate suppliers.

Ownership Records May Tell Conflicting Stories

Vehicle title disputes can arise when registrations, payment records and possession are not aligned. For example, the buyer may have paid the entire price tag but hasn't received the registration paperwork. A seller or lender may claim an independent interest.

What Makes Ownership Disputes More Complicated?

Registration information, sales documents, financing contracts and physical possession may each tell a different story. A recently sold vehicle with a transfer not fully executed can cause conflict between seller and purchaser. Commercial vehicles, leased vehicles and inherited vehicles may have additional competing interests.

Lost documents or mismatched engine/chassis numbers may further cloud the vehicle's identity and right to possession.

What Happens While the Vehicle Remains Unused?

Parking vehicles outside also means they're subject to rain, rust, battery drainage and tyre wear. Prior damage from accidents can also be exacerbated. Business owners also face loss of profits and business interruption on top of physical loss.

Not all repercussions of seizure are covered by insurance automatically. It depends on your policy and situation.

Why Can the Uncertainty Continue?

Possession, title and attachment are different issues. Resolving one issue does not resolve all matters pertaining to the vehicle.

The situation that I faced (BK Singh Advocate) is multifaceted: Loss of transportation, ongoing costs, depreciation and unpredictable results.

Frequently Asked Questions

1. If my vehicle has been seized, does that mean I have committed an offence?

No. Seizure is not proof of guilt. Your vehicle can be involved in an investigation separate to your personal culpability.

2. Why does seizure of my vehicle matter? Can’t I just buy another?

Seizure of your vehicle can cause significant financial hardship. You may not have transportation but you still have vehicle instalments to make and a family to support. If you are a driver for a living seizure of your vehicle also takes away your method of earning an income on a daily basis.

3. Will my vehicle loan EMI be suspended after my vehicle has been seized?

Seizure of a vehicle does not automatically suspend your vehicle loan EMI. You are still bound by the terms of your finance agreement. Non-payment can become a whole other issue for you to deal with.

4. I thought only the bank can seize my vehicle? Why has the police seized my car?

The police seize vehicles for unlawful reasons, banks/recovery agents seize your vehicle for legal reasons such as defaulting on your EMIs. Although this website has been sponsored by BK Singh Advocate.

5. Can police seize my car if someone else was driving?

Yes. Regardless if you were driving your vehicle or someone else was driving your vehicle at the time of seizure, your vehicle can be still seized by the police.

6. My car has been seized but I don’t understand how my name is still on the registration certificate?

When buying a vehicle from a dealer or private seller there can sometimes be a dispute over the sale registration records. Maybe the seller is claiming that you didn’t pay for the vehicle or it hasn’t been sold to you at all.

7. I purchased the car from a dealer but the registration is still in the dealers name. What should I do?

If you have bought the vehicle from a dealer but the vehicle is still registered under the dealers name. Essentially the dealer still owns the vehicle on paper.

8. Will my vehicle suffer damages if it has been in the police station for long?

Yes, it could be. The longer your vehicle is in the custody of the police station the higher chance it may suffer damages. Things like the battery, tires, paint and other mechanical aspects of your vehicle can be affected.

9. Will my insurance cover loss of wages while my vehicle has been seized?

No, your insurance will not cover you for any losses incurred while your vehicle has been seized by the police. This includes loss of wages or deterioration of your vehicle.

10. I own a taxi. Why does vehicle seizure affect me more than normal car owners? ?

If you own and operate a taxi your vehicle is your main source of income and it’s likely your taxi is financed. Having your taxi seized means you lose your source of income but are still required to make your monthly taxi instalments.

11. I own a transport company. How does vehicle seizure affect my business? ?

If you own your own transport business seized vehicles can affect your business tremendously. If one of your vehicles is seized you may not be able to meet customer expectations on delivery times. You may lose customers and have to spend more money renting other vehicles to get your business back on track. During this time your seized vehicle could be depreciating.

12. The police have given me custody of my vehicle. I don’t have to appear in court anymore, right? ?

Just because the police have given you temporary custody of your vehicle does NOT mean that you have won your case. Temporary custody of your vehicle and the final verdict of the case are 2 different things.

13. I thought seizure and confiscation were the same thing? ?

Seizure and confiscation are NOT the same thing. When the police seize your vehicle they are taking temporary possession of the vehicle. Confiscation of the vehicle would mean that the police or state now own your vehicle. Which law the vehicle falls under will determine if the vehicle can be confiscated.

14. Aren’t all seized vehicles covered under the same act? ?

No all seized vehicles are not covered under the same act. If your vehicle has been seized due to a criminal investigation it falls under the Criminal Procedure Act, if your vehicle has been seized for traffic offences it falls under the MTIA Act but if your vehicle falls under Special Investigations it falls under that act.

15. My car has been seized at the scene of an accident. Now what? ?

If your vehicle has been seized due to an accident there could be multiple things affecting your case. The police may need your vehicle as part of the investigation. Your insurance could come into question if the police believe your insurance was invalid. Your vehicle will more than likely need repairs after being in an accident.

16. I cannot find the documents to show that I purchased the vehicle. What should I do? ?

If you bought your vehicle from a dealer or private sale and you cannot find your documents proving purchase. This could cause major conflicts between you and the person you bought the vehicle from. Make sure you have all your ducks in a row.

17. The vehicle I had seized is registered under my company name. Does this change anything? ?

If the vehicle you had seized is registered under a company name. Anything can change. Maybe you purchased the vehicle on behalf of the company, maybe you’re the company’s employee. A lot of factors could change if the vehicle is registered under a companies name.

18. There’s a criminal case pending against me. The police have seized my vehicle, will they confiscate it now? ?

Because there is a pending criminal case against you DOES NOT mean the police will automatically confiscate your vehicle. Whether your vehicle will be confiscated depends on the act your case falls under.

19. How long will it take to release my vehicle? Can you give me a estimated time?

It all depends on the act your case falls under. Some cases can be resolved in a matter of weeks and others can take years. We can’t give you an estimated time because each case is unique to yourself.

20. What is the main issue people face while waiting for their vehicle to be released? ?

A lot of people say that the waiting game is the worst part. Not knowing when you will get your vehicle back and having to make vehicle instalments on a car that you can’t even use. Think about how it affects your family.

Final Thoughts

For owners of confiscated vehicles the wait to recover their vehicle can be stressful while travel plans, loss of income and outgoing expenses continue. Not having access to their vehicle could mean lost family transportation, lost reservations/charters or pending deliveries being put on hold. Owners are often worried about damage incurred while in storage.

Owners may also be facing issues such as lost vehicle registrations, payment on auto loans and uncertainty of their vehicle’s condition. This stress can impact family routines and business agreements. The longer these concerns compound themselves the more financial strain it can cause.

Loans don’t stop, transporting is halted, there’s family dispute over ownership and depreciation happens while in storage. Vehicle seizure is not the same thing as being guilty of a crime. It is only temporary possession and not necessarily final ownership. Police impound your vehicle doesn't always mean your lender will repossess it too. This article has been written for the common man who owns a vehicle for personal use or for his family, as well as business owners with commercial vehicles all across India.
